The TERMS AND CONDITIONS are in TWO SECTIONS 1. Tour Operator / Third Party Booking Conditions (Click here) 2. Our (Visit Anz) Terms and Conditions (Click here) Tour Operator / Third Party Booking Conditions Clients booking travel arrangements through Visit ANZ will be expected to be aware of specific Booking Conditions for the relevant tour operators / third party BEFORE booking, and where requested, to acknowledge this in writing. Any flights which might be booked for these land-only arrangements will be a separate transaction where the ATOL tour operator's confirmation invoice will be passed on to the client. On application clients will be advised of these Booking Conditions along with the name of the tour operator(s) or travel supplier(s) & any applicable ATOL licence number(s), before any travel arrangements are confirmed. NOTE: Although a retail travel agent does not normally have any particular Booking Conditions of its own, Visit ANZ feels that in the new e-commerce trading environment, it is helpful to outline its own role and to set out some of the likely conditions that tour operators impose. TOUR OPERATOR/THIRD PARTY BOOKING CONDITIONS:
Clients booking travel arrangements through Visit ANZ will, on application, be
made aware of the specific Booking Conditions of relevant tour operators/third
parties BEFORE booking and will then be expected to acknowledge this in
writing, usually by signing the tour operator/third party Booking Form.Although
Booking Conditions do vary amongst tour operators, in broad termsthe key
elements are usually similar, in that:* a signed Booking Form together with a
non-refundable deposit are requiredwhen booking* the balance is normally
payable 8-13 weeks before departure* amendment fees and/or cancellation fees
apply to any changes made by clients* alterations/cancellations by the tour
operator may be permitted, howeverfor changes made close to departure some
compensation may be payable by theoperator* personal travel insurance is
normally recommended to be taken out byclients making a booking and some
operators may require an 'Insurance Disclaimer Form' to be completed if you
have arranged your own travelinsurance. FORCE MAJEURE: Neither Visit ANZ nor its supplier tour operators/third parties can accept responsibility or offer compensation where the performance of contractual obligations is prevented by circumstances amounting to what is normally considered 'force majeure' COMPUTER VIRUSES: Whilst Visit ANZ takes all reasonable steps to exclude viruses from this website, (most viruses usually come attached to e-mail documents), it cannot ensure such exclusion, and no liability is accepted for viruses. You are therefore recommended to take all appropriate safeguards before downloading information from this site, from any of the sites that are linked to this site or from the internet in general. YOUR RIGHT OF ACCESS TO INFORMATION WE HOLD ON YOU: You can obtain a copy of the information that you have provided to us bywriting, faxing or E-mailing us. CHANGES TO PRIVACY POLICY:Any changes to our Privacy Policy will be posted on this page. Yourcontinued use of this website will constitute your agreement to the versionof this Policy current at the time of your use. LINKS TO OTHER WEBSITES: This site contains links to other sites where the content is not controlled by Visit Anz. These sites may send you cookies and collect data and personalinformation. Our Terms and Conditions (Visit Anz) These conditions will form part of the contract between St Leonards Travel Ltd trading as Visit ANZ. Please note that conditions may vary depending on whether you book a package or other holiday arrangements. The term package means a combination of two of the following, transport, accommodation or other tourist services forming a significant part of the booking which are booked together and for which full payment is made to us. All remaining components including transport and accommodation booked at separate times and not at an inclusive price constitutes other holiday arrangements which we arrange for you the customer as a booking agent. Where your contract is with the supplier of the service(s) concerned we cannot accept any liability in relation to those services which rest solely with the supplier concerned. Copies of the relevant suppliers conditions are available on request. PAYMENT: On confirmation of your booking, a deposit of 10% or £100.00 per person which ever is the greater is required. Final payment is due 8 weeks prior to passengers arrival into Australia . A number of hotels and suppliers also require deposits on confirmation of services and if this is the case, we will advise you accordingly. Your contract comes into existence when a confirmation invoice is received by you the customer from us. For use of a credit card, a fee of 2% is charged. There is no charge when Debit cards are used CANCELLATIONS AND AMENDMENT BY YOU If you cancel before the balance becomes due, you will forfeit your deposit only. Cancellations must be advised in writing and the cancellation only takes effect from the day written confirmation is received in our office. More than 56 days - Deposit only 56-43 days 30% of total 42-29 days - 50% of total 28-2 days 90% of total within 2 days 100% of total After departure from the U.K. there will be no refund of any unused component of your holiday. Visit ANZ reserve the right to charge an amendment fee of up to £25 per person for any change to the itinerary by the customer up to 8 weeks before departure. Amendments after full payment has been made constitute a cancellation and the applicable cancellation charges apply. CANCELLATIONS AND AMENDMENT BY US: Very occasionally we have to change your holiday after the confirmation invoice has been issued. If this should happen we will offer you three choices (a) accept the change or (b) change your holiday arrangements to a comparable alternative we can offer (if more expensive you must pay the difference) If cheaper we will refund the difference or (c) cancel and receive a full refund. If your travel arrangements are cancelled or changed after the balance has been paid we will pay compensation of £25 per person. COMPLAINTS: If you have a problem during your holiday, please inform the relevant supplier immediately who will do their best to rectify the situation. If they are unable to fix the dispute to your satisfaction then you must Fax Visit ANZ on 01424 722304 and we will endeavour to assist. Should your problem remain unresolved, a complaint should be made in writing giving all relevant details within 28 days of the end of the arrangements in question. Problems can only be resolved if we and the service providers are made aware as soon as they occur. We regret we cannot accept liability in relation to any complaint or claim which is not notified in accordance with this clause.(Please note the following paragraph does not apply to any bookings where we act as an agent for the service provider concerned)It is unlikely that you will have a complaint that cannot be satisfied amicably between us. However disputes arising out of, or in connection with this contract which cannot be settled amicably, may (if you wish) be referred to arbitration under a special scheme which, though devised by arrangement with the Association of British Travel Agents, is administered quite independently by the Chartered Institute of Arbitrators. The scheme
provides for a simple and inexpensive method of Arbitration on documents alone
with restricted liability on you in respect of costs. The scheme does not apply
to claims for any amount greater that £5,000 per person or £15,000
per booking . Also it does not apply to claims which relate to physical injury
or illness. If you choose too proceed to Arbitration under this scheme, you
must send a written notice of your decision to ABTA within 9 months after your
scheduled date of return. Full details of the scheme are available from ABTA,

OUR LIABILITY; Packages only: We accept responsibility if you suffer personal injury or death as a result of any of the services or facilities we arrange for you unless the deficiency, personal injury or death is not due to our fault, nor to the fault of our suppliers, but is due to your fault, to the actions of someone unconnected with your holiday, or to an unusual or unforeseeable circumstance beyond our control which neither we nor our suppliers could have anticipated or avoided even exercising all due care. Except in cases of personal injury or death, or where an International Convention applies, the maximum compensation we will pay for deficiency or lack of reasonable standard (a deficiency) is such an amount as we consider reasonable having regard to the seriousness of the deficiency and the cost of the defective component. Our acceptance of liability in this clause is subject to you assigning to us your rights against any agent or supplier of ours in any way responsible for the deficiency, death or personal injury. We cannot accept responsibility if you suffer death or personal injury from an injury from an activity which is not part of the holiday arrangements we made for you. Other travel arrangements: because we act only as a booking agent for other travel arrangements, we have no liability whatsoever for those arrangements and, in particular, no liability for any illness, personal injury, death or loss of any kind. CHILDREN: Reduced rates are applicable for children for many services, however the age of the child must be advised at the time of booking. If the age of the child is not advised then we reserve the right to charge the full adult cost for booking. GOVERNMENT TAXES/GST: The Northern Territory Bed Tax of 5% and the Sydney Bed Tax of 10% is included in all rates within this tariff. Should these taxes be changed at any time, we reserve the right to re-quote the rates at the time of booking. INSURANCE: We recommend that all passengers are fully insured to cover advance purchase airfares, as well as full medical, including accident and sickness, and travel insurance including baggage and disrupted travel arrangements. FORCE MAJEURE: This means that we will not pay you compensation if we have to cancel or change your travel arrangements in any way because of war, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other unforeseen circumstances that may amount to force majeure.
